
W. Donald Goodfellow, Q.C., C. Arb. is a practicing lawyer in Calgary and is a member of the Law Societies of Alberta, British Columbia, Yukon and Northwest Territories. Mr. Goodfellow's practice is mainly focused in the area of construction-related matters including construction litigation. He teaches periodically for various trade and construction Associations as well as the project management courses at the University of Calgary. Mr. Goodfellow additionally taught builders' liens for the Bar Admission Course of The Law Society of Alberta for over 30 years and is a frequent lecturer for the Legal Education Society of Alberta.
Mr. Goodfellow is listed in “The Canadian Legal Lexpert® Directory. In the 2000 edition, he was listed as the most frequently recommended construction law practitioner in Calgary. (There was no edition published in 2001). In the 2002 edition, he was listed as the most frequently recommended leading construction practitioner in Calgary. In the 2003 edition, he was one of two leading construction practitioners, most frequently recommended in Calgary; in the 2004 edition, he was listed as consistently recommended as a leading construction practitioner. In the 2005 edition, he was one of four leading construction practitioners in Calgary most frequently recommended. Mr. Goodfellow has been listed since 2000 as one of the leading lawyers in construction law in the “Lexpert®/American Lawyer Media Guide To The Leading 500 Lawyers in Canada.” In the 2005 edition, he was listed as one of the eleven leading construction law practitioners in Canada and one of three from Alberta. In the 2006 edition, Mr. Goodfellow was listed as consistently recommended as a leading practitioner in construction law. Additionally, he has been listed in Naifeh & Smith’s Best Lawyers in Canada (2006). He is listed in the 2005 Hill International “Who’s Who” of construction law lawyers and is listed in The International Who’s Who of Construction Lawyers 2007. Mr. Goodfellow is listed in the National Register’s “Who’s Who” and is listed in Martindale-Hubbell with a Peer Review Rating of AV, “A” being a legal ability rating Very High to Preeminent and “V” being a Very High general ethical standard rating. An “AV” rating is the highest given by Martindale-Hubbell.
Mr. Goodfellow represented the Canadian Bar Association and taught law office management to lawyers in Shanghai in 1998. Mr. Goodfellow taught lawyers in Ontario at Osgoode Hall in Toronto in May 2001 regarding a Construction Law Specialist Program conducted by Osgoode Hall in Toronto. The Law Society of Upper Canada Specialization Certification Board considers this a credit course towards the Continuing Legal Education requirements of the Law Society of Upper Canada for certification in construction law.
Mr. Goodfellow is a founding Fellow of the Canadian College of Construction Lawyers. He was counsel for M.J.B. Enterprises Ltd. which is a recent Supreme Court of Canada case which sets out the meaning of the privilege clause and the obligation of those who call for tenders. This landmark decision is a leading case in the law of tenders and sets out the rights and obligations of the parties to the tendering process.
Mr. Goodfellow has written various articles for many legal publications on construction related matters and is a member of the Advisory Board of the Construction Law Letter.
Mr. Goodfellow has served as a Bencher of the Law Society of Alberta, was National Chair of the Construction Law Section of the Canadian Bar Association, and served for five years as National Treasurer of the Canadian Bar Association. Mr. Goodfellow was a member of the Board of Directors of the Canadian Bar Insurance Association for the years 1999 to 2005. Mr. Goodfellow had previously served on the Board of Trustees of Kiwanis International, and is a Past President of the Calgary Southwest Federal Liberal Association and a past member of the Board of Directors of the Liberal Party of Canada in Alberta. Mr. Goodfellow has been appointed by the Archbishop of Edmonton as a Governor of the Foundation of St. Joseph’s Seminary and Newman Theological College.
Mr. Goodfellow was the recipient of the Treasurer’s Award in August 2001 from the Canadian Bar Association for his years of service as National Treasurer of the Canadian Bar Association from 1994 to 1999. In October 2001, Mr. Goodfellow was awarded the Legal Education Society of Alberta 25th Anniversary Award for Southern Alberta for his contribution to the Bar Admission Course of the Law Society of Alberta as he has been a lecturer on builders’ liens for the Bar Admission Course from 1971 to 2001.
Mr. Goodfellow has appeared before the Supreme Court of Canada, the Federal Court of Canada, the Courts of Alberta, British Columbia, the Northwest Territories, and the Yukon, as well as occasional appearances in the Courts of Saskatchewan, Manitoba and Ontario.
